Employment Regulations Update

The second half of 2007 and these last few months have been an exceptionally busy for Government as a number of regulations amending existing legislation have been published in order to perfect compliance with the various EU Directives and Regulations that have already been incorporated in our law. 

 

Over the last months,  the Government implemented a few other regulations issued under EIRA 2002, which came into force to amend or replace existing regulations, and that may be interest to you.

 

Wage Increase (Employees) National Standard Order, 2007 – L.N. 428 of 2007
 

Parental Leave Entitlement (Amendment) Regulations 2007 – L.N. 430 of 2007
 

This amendment made some minor amendments to the Parental leave regulations such as the change in the department which is designated as competent authority for providing the adoption certificate.

 

Protection of Maternity (Employment) (Amendment) Regulations, 2007 – L.N. 431 of 2007
 

This amendment rendered all 14 weeks of maternity paid leave

 

Minimum Special Leave Entitlement Regulations, 2007 – L.N. 432 of 2007
 

These very important regulations finally tapped into the vacuum that existed in respect of those employers that were not covered by a WRO with respect to sick leave (now set at 2 working weeks) and the other minor leave entitlements such as birth and bereavement leave.

 

Extension of Applicability to Service with Government (Parental Leave Entitlement Regulations and Urgent Family Leave Regulations) Regulations, 2007 – L.N. 433 of 2007
 

The title of these regulations is self explanatory.

 

Equal Treatment (Amendment) Regulations of 2008 – L.N 137 of 2008
By means of this legal notice the Regulations now make a clear reference to the European Directives by reason of which they were issued as regulations in Malta.

 

Contracts for Service for a Fixed Term (Amendment) Regulations of 2008 – LN 239 of 08
 

By means of this legal notice government removed the illegal exclusions that were present in the 2007 regulations in respect of employment with government and also regulated the position for those employees on an indefinite contract with government that are given a fixed term appointment for longer than 4 years.

 

In addition, this legal notice removed changed completely the rule in relation to those persons who may be given a contract of employment which is longer than 4 years.

 

Part Time Employees (Amendment) Regulations of 2008 – LN 240 of 08
 

This legal notice replaced once again the definition of principal employment.
