Tribunal Decides on Constructive Dismissal
In a recent decision, the Industrial Tribunal upheld the claim of an employee for compensation due to unfair dismissal notwithstanding the fact that the employee had in fact resigned from her employment. The tribunal decided that a conversation between the employee and her employer where the employer told his employee that he had lost faith in her amounted to a constructive dismissal in that although the employee resigned, she was in fact forced to do so by her employer.
