Tribunal Orders Employer to pay Lm 11,300 and Lm 9,200 to two employees for unfair dismissal

In 3 separate but linked decisions, the Industrial Tribunal awarded Lm11,300 and Lm 9,200 to two different employees and ordered reinstatement with regard to a third employee. The employees had all been employed with their employer since the 1980?s and their employment was terminated for reasons of redundancy in 2002.

The tribunal held that the employer did not observe the last in first out rulewith respect to such employees and that therefore the dismissals have to be considered unfair. The Tribunal also considered that although the employee?s employment was terminated in 1995 with the employer in his own name and re-engaged by a limited liability company with the same trade name, owned by the same persons, both empoyments are to be considered one for purposes of length of service.
